Indiana consumer obtains judgment against Hyundai Motor America, Inc. in “Lemon Law” dispute

On September 15, 2021, Hamilton County, Indiana resident, Melanie Adams, obtained a judgment against Hyundai Motor America, Inc. in the amount of $10,000 ending her year long “Lemon Law” battle against the automobile manufacturer. Adams’ claims arose from Hyundai’s failure to repair defects in her 2018 Hyundai Sonata. Within just a few months of Adams’ purchase, the vehicle began to make abnormal rattling noises on acceleration. After providing Hyundai with five (5) opportunities to repair the vehicle, Adams had enough. She contacted Krohn & Moss, Ltd. Consumer Law Center® who filed suit under the federal Magnuson-Moss Warranty Act, also known as the federal Lemon Law, against Hyundai on August 31, 2020. After a year of litigation and on the eve of trial, Hyundai agreed to have judgment entered against itself in the amount of $10,000. Adams’ attorney handling the case, John Barker, summed up the victory, “A judgment against a gigantic corporation no matter how big or how small is a tremendous victory for all consumers. This judgment sends the message that consumers will not back down and they have recourse to pursue claims against automobile manufacturers who sell them a lemon of a car.”
