Class Action Lawsuit May Limit Recoveries of Ford Focus and Fiesta Owners

Roughly 1.5 million people are registered owners of Ford Focus and Fiesta vehicles who may be experiencing an excessive shuddering condition due to transmission and clutch defects in their vehicles. If you are experiencing such issues with your vehicle, we are here to help ensure you receive maximum compensation.

Who is affected?

Owners of defective 2012 to 2016 Ford Focuses and 2011 to 2016 Ford Fiestas.

What kind of defect?

Certain Ford Focus and Fiesta vehicles are equipped with a defective PowerShift Dual-Clutch Automatic (DPS6) transmission, causing an excessive “shuddering” condition in the transmission. The transmission is causing the vehicle to slip, buck, kick, or jerk; as well as causing sudden or delayed vehicle acceleration. Owners are experiencing symptoms including lunging or jerking forward when attempting to decelerate, as well as hesitation when attempting to accelerate. If your vehicle is experiencing any issues of this nature, you are automatically included a class action lawsuit that may limit your rights if you do not take affirmative action to exclude yourself from the class.

What’s happening with the class action lawsuit?

Ford Motor Company agreed to settle a class action involving these vehicles, recognizing that many Focuses and Fiestas are equipped with defective transmissions. The class action settlement is subject to approval of the Court, and if approved, will set forth relief for consumers. However, the proposed relief may not sufficiently accommodate many consumers for what they have experienced.

Why do I want to “opt out” of the class action settlement?

Unlike a standard lawsuit, if you don’t “opt out” of a class action settlement, you are automatically included as a class member. This means you are bound to the relief that the Court approves for all affected consumers. Based on the assessment of the attorneys at Krohn & Moss, Ltd. Consumer Law Center®, if you are a registered owner of a faulty Ford Focus or Fiesta, you may be entitled to more than the proposed settlement.

So, what should I do?

If you own a Focus or Fiesta and have experienced transmission “shuddering” conditions, contact the attorneys at Krohn & Moss, Ltd. Consumer Law Center® and we will evaluate your claim on an individual basis. Each case is different, so don’t let the class action suit potentially limit your compensation.

After an evaluation, should we take your claim and prevail, Ford Motor Company is responsible to pay your attorneys’ fees. If you do not win your case, we do not charge a fee. We only get paid if you win or settle your case.
