What Is the Lemon Law in Cincinnati, Ohio?

The lemon law in Cincinnati, also known as the Ohio Lemon Law, is designed to protect individuals who have purchased a motor vehicle in Ohio that turns out to be defective.

If your vehicle has a defect or condition that substantially impairs its use, value, or safety, the state lemon law entitles you to a refund or a replacement vehicle. However, to be eligible for this compensation, you must first allow the manufacturer a reasonable opportunity to resolve the issue.

The defect(s), and at least the first repair attempt, must occur within the first year of ownership (from the date of delivery to the original owner) or within 18,000 miles, whichever comes first. If the defect persists after a reasonable number of repair attempts, the vehicle is considered a lemon. The state lemon law defines “a reasonable number of attempts” as:

  • 1 attempt: for any defects that could cause death or serious bodily injury
  • 3 attempts: for any single defect
  • 8 attempts: for any combination of defects
  • 30 cumulative days out of service: for any combination of defects

The law was designed with new, non-commercial motor vehicles in mind, so most passenger cars, motorcycles, trucks, and certain recreational vehicles are covered. If you don’t meet all the requirements of the state law, you may still have recourse under the Magnuson-Moss Warranty Act, a federal law that provides additional consumer protections throughout the duration of your warranty, which could be as long as ten (10) years or 100,000 miles in certain circumstances.

How a Cincinnati Lemon Law Attorney Can Help

You don’t have to figure this out on your own. Filing a claim with Krohn & Moss, Ltd. is straightforward, and we guide you through every step of the process:

  1. We review your case: We discuss repair records, warranty documents, and eligibility during your free case review. We’re always honest about your situation and your chances of success.
  2. We notify the manufacturer: If you have a valid claim, we’ll start the legal process by notifying the manufacturer in writing about the defect.
  3. We negotiate a settlement: Whether it’s a refund or replacement, we fight for what you’re entitled to. If you’re not satisfied at this stage, we’re always ready to take things to the next level to secure what you’re owed.
  4. We resolve the case: The overwhelming majority of our cases settle outside of trial, but we’re always prepared to litigate if necessary. If you win your case in court, the Ohio state law requires the manufacturer to pay your attorney’s fees.
