The Magnuson-Moss Warranty Act
The Magnuson-Moss Warranty Act is a federal law that governs the content
and regulation of consumer product warranties. This Act is designed to protect the
rights of consumers and detail the obligations of warrantors that are offering written
warranties with their consumer products.
The Magnuson-Moss Warranty Act gives consumers considerable rights in dealing
with manufacturers of “lemon” products. The Act requires that all warrantors
meet certain minimum requirements when issuing a written warranty to a consumer
and that the terms of the written warranty be fully disclosed before purchase.
As detailed below, the Act establishes three basic requirements that must be met
by a manufacturer, seller, or warrantor of a consumer product.
What the Magnuson-Moss Warranty Act Requires
- A warrantor must designate or title its written warranty as either "full"
or "limited.”
- A warrantor may not disclaim implied warranties that arise as a matter of law if
it enters into a warranty or service contract with the consumer. A warrantor must
take all necessary measures to live up to the obligations set forth in its warranty
and warrantors are only allowed a “reasonable” opportunity to cure any
repairs needed under the warranty. Should a warrantor fail to repair or take other
necessary measures as required by its warranty after being afforded a reasonable
opportunity to do so, the warrantor may be liable for monetary damages, refund,
replacement, and attorneys’ fees and costs.
- A warrantor must ensure that warranties are available where consumer products are
sold so that consumers may read them before purchase.
How does the Magnuson-Moss Warranty Act help Consumers?
Although the Act does not require a manufacturer to provide purchasers with a warranty
as explained above, if a warranty is provided, the Act provides various protections
for the consumer by making it easier for consumers who purchased “lemon” products
to bring a claim for breach of warranty. By allowing consumers to recover court
costs and reasonable attorneys’ fees should they prevail, the Act makes it economically
