Jury Awards Consumer $32,000 for Nissan Altima Sold as “New” with Prior Title Problems

A jury in Illinois awarded $32,000 to an Illinois consumer as a result of the fraud committed by Orland Park Nissan in selling a supposed “new” car. Krohn & Moss, Ltd. Consumer Law Center® filed a lawsuit on behalf of a consumer who paid $24,000 for a Nissan Altima she thought was a new car. The car only had 178 miles at the time of purchase and the salesman and finance manager told her it was a new car with the manufacturer’s warranty. However, the dealer knew the car had been issued a prior Salvage branded title and was titled as a used car before it sold the car to the consumer. When getting an oil change from a different Nissan dealer, the consumer was shocked to learn that her warranties were void as a result of the Salvage title issued for the car.

The jury awarded the consumer approximately 50% of the purchase price of the Altima for over paying for the car, and an additional $20,000 in punitive damages to punish Orland Park Nissan for its fraud and to try and prevent these fraudulent practices from happening again. Krohn & Moss, Ltd. Consumer Law Center® represented the consumer free of charge as she was also able to seek payment of her attorneys’ fees and costs incurred directly from Orland Park Nissan pursuant to state laws. Eric Kaczander of Krohn & Moss, Ltd. who was the lead trial attorney for the consumer, commented on the jury’s award, “A buyer has the right to know the true history of the car she is buying and car dealers can no longer take advantage of unsuspecting consumers. Laws are now in place to hold the dealer accountable for its fraudulent actions.”
